These Terms of Service (“Terms”) govern your use of the Kinetic iOS app (“Kinetic”, the “App”). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
Kinetic is an iOS app that analyzes barbell exercise form using Apple Vision 3D pose estimation and AI coaching powered by Anthropic’s Claude API. Kinetic is provided by Mateo Calderon (“we”, “us”, “our”).
You must be at least 13 years old (16 in the EEA) to use the App. By using the App, you represent that you meet this requirement. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian review and agree to these Terms on your behalf.
Kinetic offers paid subscription plans (Basic Weekly, Basic Monthly, Pro Monthly). Each plan includes a fixed number of video analyses per billing period, as displayed on the purchase screen.
Subscriptions are billed through your Apple ID. Pricing, billing terms, free trial eligibility, and renewal dates are displayed at the time of purchase. All purchases are subject to Apple’s Standard EULA in addition to these Terms.
Subscriptions renew automatically at the end of each billing period unless auto-renew is turned off at least 24 hours before the current period ends.
You can manage or cancel your subscription any time via iOS Settings → Apple ID → Subscriptions. Deleting your Kinetic account does not cancel your Apple subscription.
Refunds are handled by Apple in accordance with their policy. We do not process refunds directly.
If you are eligible for a free trial, your subscription auto-renews at the full price after the trial ends unless you cancel before the trial ends.

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices you own or control.
You retain all rights in the videos you record or import (“User Content”). Videos are processed on your device and are not uploaded to our servers.
When you request AI coaching, a structured summary and three still frames extracted from your video are sent to Anthropic’s Claude API through our Cloud Function, as described in our Privacy Policy. By requesting coaching, you grant us and our processors the limited right to process this content for the sole purpose of generating your coaching feedback.
You are responsible for ensuring you have the right to record and analyze any video you import into the App (for example, if another person appears in frame).
Kinetic’s coaching feedback is AI-generated output. It is not medical advice, physiotherapy, or personal training, and it is not a substitute for guidance from a qualified professional. The pose estimation and form checks are approximations and may be inaccurate due to camera angle, lighting, clothing, or algorithm limitations.
Do not rely on Kinetic to determine whether a lift is safe. Lifting weights carries inherent risk of injury. Consult a physician before beginning any exercise program. Stop immediately if you feel pain or dizziness.
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. We do not warrant the accuracy, completeness, or reliability of any pose estimation, form check, or AI coaching output.
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability; in those jurisdictions the exclusions and limits above apply to the maximum extent permitted.
You agree to indemnify and hold harmless Kinetic, its officers, employees, and agents from any claim, loss, or liability (including reasonable attorneys’ fees) arising out of your use of the App, your User Content, or your breach of these Terms.
We may suspend or terminate your access to the App at any time if you breach these Terms or engage in conduct that may harm other users or us. You may terminate these Terms at any time by deleting your account.
We may update the App and these Terms from time to time. Material changes to the Terms will be announced in the App or by email. Continued use of the App after the change indicates acceptance.
These Terms are governed by the laws of [your state/country], without regard to conflict of law rules. The exclusive venue for any dispute is the state or federal courts located in [your county/city], and you consent to personal jurisdiction there.
